ABILENE, Texas (AP) — A Dyess Air Force Base airman who faces court martial on charges of adultery and neglecting a toddler who died wants to be tried by a military judge instead of a jury.
1st Lt. Nicole Ferrara, a military spokeswoman, says the jury was dismissed after the defense of airman Christopher Perez's made the request Wednesday.
At the time of the alleged offenses, Perez lived with Tiffany Klapheke (klah-PEEK'), wife of airman Thomas Klapheke.
Tiffany Klapheke has said her husband's deployment made her too stressed to take care of their three children, which led to the death of her 22-month-old daughter from malnutrition and dehydration in August 2012. She is scheduled for trial in January.
Upon his return, Thomas Klapheke filed for divorce.
