'Felony stupid' fake-gun prank gets 5-year sentence

GRAND JUNCTION — A Colorado man who pointed a toy gun at an officer last year and called it a Halloween prank has been sentenced to five years in prison.

Thirty-year-old Patricio Preciado of Grand Junction was sentenced Thursday after pleading guilty to felony menacing. Police officers at the time called it a case of "felony stupid."

The Daily Sentinel reports (http://bit.ly/1pGQmPa ) that Preciado had four prior felony convictions and has violated probation.

Grand Junction police officer Cody Kennedy testified that Preciado pointed a black plastic toy handgun at Kennedy's head from 15 feet away. Kennedy also said that Preciado was not smiling to indicate he was joking.

Kennedy was in uniform and drew his own weapon, at which time Preciado said he was kidding. No shots were fired.
