A man who shot and killed an intruder in his home in May was justified under Colorado's "Make My Day" law, the 4th Judicial District Attorney's Office announced Tuesday.
Felipe Garcia, 33, was shot and killed May 14 at the Georgetown Square Townhomes, 2005 N. Academy Blvd. Neither police nor the District Attorney's Office has named the shooter.
A week earlier, Garcia separated from his wife, investigators said. Two days before the shooting, Garcia called the shooter and threatened him, they said.
The shooter, his girlfriend and three children were upstairs in their home May 14 when they heard a boom from downstairs. The shooter ran to the stairs and saw Garcia coming toward him. After asking Garcia to stop and saying he was sorry, the man shot Garcia once in the chest.
A police investigation found that Garcia kicked down the back door with his right shoe, thereby unlawfully entering the shooter's home. The DA's office ruled the shooting "justified" because the resident was protecting himself and his home.
