Nevada Ave, Ste 604 Colorado Springs, Colorado, 80903 719-385-6880 On or after June 2, 2016, the City of Colorado Springs, Community Development Division, will submit a request to the Department of Housing & Urban Development (HUD), for the release of CDBG funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following project: Project Title: Infrastructure Improvements to N. Cascade Avenue & Winters Drive. Purpose: Mountain Metropolitan Transit, located in Colorado Springs, Colorado, operates a public transit system with routes throughout the City. A portion of Route 9 along Cascade Avenue between Fillmore St and the Templeton Gap floodway, and along Winters Drive between N. Cascade Avenue and N. Nevada Avenue, lacks a significant number of ADA compliant features, creating a safety hazard for residents of the low- to moderate-income neighborhoods adjacent to the route. Mountain Metropolitan Transit proposes to remedy substandard conditions along this portion of the route by installing new sidewalk with related curb and gutter work, repairing or replacing broken and offset sections of existing sidewalk, installing accessible curb ramps, and improving transit stop areas with ADA compliant waiting pads, signage, and striping. The project includes improvements to related utilities located in City right-of-ways, drainage improvements, acquisition of required easements, and other work typically associated with these types of projects, including returning the site back to its original condition by restoring or replacing landscaping, stairways, fencing, and retaining walls. Location: N. Cascade Avenue between Fillmore Street and the Templeton Gap floodway, and Winters Drive between N. Cascade Avenue & N. Nevada Avenue. Estimated Cost: Total Project Cost: $1.1M, including $400,000 in CDBG funds. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the City of Colorado Springs, Community Development Division, 30 S. Nevada Avenue, Suite 604, Colorado Springs, Colorado, 80903, where the record is available for review and may be examined or copied weekdays 8 A.M to 5 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Colorado Springs, Community Development Division. RELEASE OF FUNDS The City of Colorado Springs, Community Development Division, certifies to the Department of Housing & Urban Development (HUD), that Jeffrey H. Greene, in his capacity as Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Colorado Springs, Community Development Division, to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City of Colorado Springs, Community Development Division's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Colorado Springs; (b) the City of Colorado Springs, Community Development Division, has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. The Department of Homeland Security's Federal Emergency Management Agency (FEMA) solicits technical information or comments on proposed flood hazard determinations for the Flood Insurance Rate Map (FIRM), and where applicable, the Flood Insurance Study (FIS) report for your community. These flood hazard determinations may include the addition or modification of Base Flood Elevations, base flood depths, Special Flood Hazard Area boundaries or zone designations, or the regulatory floodway. The FIRM and, if applicable, the FIS report have been revised to reflect these flood hazard determinations through issuance of a Letter of Map Revision (LOMR), in accordance with Title 44, Part 65 of the Code of Federal Regulations.   • May 24 - Public Notice Notification is hereby given to the public that the City of Colorado Springs, Colorado has requested funding from the Federal Emergency Management Agency (FEMA) for a proposed channel stabilization project along Sand Creek. This notification is provided pursuant to the National Environmental Policy Act (NEPA), Section 106 of the National Historic Preservation Act (NHPA), Executive Orders 11988 - Floodplain Management, and Executive Order 11990 - Wetland Protection, and Federal agency implementation procedures described in 44 C.F.R. Part 9 and Part 10. Funding from FEMA's Hazard Mitigation Grant Program will be utilized. The purpose of FEMA's mitigation program is to implement cost-effective mitigation projects that will reduce the overall risk to populations and property. This project will repair the extensive channel bank erosion immediately downstream of the Platte Avenue Bridge. The reach length of this project is approximately 2,300 linear feet. Improvements will begin at the Platte Avenue Bridge and end at the confluence of Sand Creek and West Fork Sand Creek. The proposed design and construction activities will include construction of four grouted boulder drop structures ranging in height from 6.7 feet to 10.2 feet. These structures will slow the flow of water through the creek and stabilize the bottom of the channel and prevent future erosion around the Platte Avenue bridge piers and buried utilities. The proposed design also includes bank protection and stabilization between each of the drop structures. This includes riprap bank protection on the outside of bends and downstream of drop structures and bioengineered bank stabilization where riprap lining is not required. The bioengineered bank stabilization is anticipated to comprise of native vegetation and willow staking. The proposed bank stabilization and concrete structures will slow the erosive flood waters and protect the channel bottom and slopes against damages during the minor storm events (2, 5, 10 yr. floods) and would require minimal maintenance after the higher storm events (100 yr. & 500 yr. floods). Construction activities would be in accordance with all applicable federal, state and local laws, regulations and ordinances. This action requires the City to acquire a Floodplain Development Permit, and to comply with their local floodplain ordinance and the National Flood Insurance Program regulations. The President of the United States has issued Executive Orders that require Federal Agencies to focus attention on the environment and on human health and safety when considering the funding of an action. Executive Orders 11988 - Floodplain Management and 11990 - Wetland Protection require federal agencies to avoid to the extent possible the long and short-term adverse impacts associated with the occupancy and modification of floodplains/wetlands and to avoid direct and indirect support of floodplain/wetland development wherever there is a practicable alternative. With this public notice, FEMA is informing the public that the proposed action will occur in areas that are mapped within the 100-year floodplain and floodway, as well as wetlands. There are no practicable alternatives to the purposed project and it is anticipated that long-term impacts to the floodplain and wetlands will be beneficial, with potential minor, short-term impacts during the construction process. In order to minimize impacts to wetlands, appropriate erosion and sediment control measures will be installed to control the discharge of pollutants from the construction site. Any impacts to jurisdictional wetlands will be addressed in compliance with Section 404 of the Clean Water Act. FEMA has also evaluated potential effects of the proposed project on endangered species, and historic properties, and determined there will be no significant impacts to these resources. A public comment period for the proposed project described in this notice will remain open for 14 days from date of publication. If no substantive comments are received, the proposed project may proceed no sooner than 14 days after the comment period closes.
